In terms of the constitution, the White Paper on Local Government and the suite of other pieces of legislation particularly the Municipal Systems Act, 32 0f 200, municipalities

  • Are required to structure and manage their administration and budgeting.
  • Should plan processes to give priority to the basic needs of the community
  • Should ensure all programmes are aimed at improving the socio-economic development of the community.
  • Should participate in national and provincial development programmes.

In addition the Municipal Systems Act prescribes that decision making at Municipal level should be inclusive, democratic and sensitive to the development and construction programme.

Therefore the legislation is mainly focused on key areas of accountability and transparency combating corruption ensuring service delivery and risk management.
